# Barulho Exagerado é Crime: STJ Decide que Poluição Sonora Não Precisa de Perícia

***STJ reforça que o crime de poluição sonora prescinde de prova pericial, bastando o descumprimento das normas de emissão sonora para sua caracterização***

 A poluição sonora é um dos problemas ambientais mais recorrentes em áreas urbanas, afetando diretamente a qualidade de vida da população. O Superior Tribunal de Justiça (STJ) reafirmou recentemente que o crime de poluição sonora é de perigo abstrato, ou seja, não exige a comprovação de danos concretos à saúde humana por meio de perícia técnica para sua configuração.

 Essa decisão, proferida pela 5ª Turma do STJ, deu provimento ao recurso especial do Ministério Público de Minas Gerais, mantendo a imputação contra o proprietário de um bar acusado de ultrapassar os limites de emissão sonora previstos em normas regulamentadoras.

 **O que diz a lei?**

 O crime de poluição sonora está previsto no artigo 54 da Lei 9.605/1998, a Lei dos Crimes Ambientais, que dispõe:

 *“Causar poluição de qualquer natureza em níveis tais que resultem ou possam resultar em danos à saúde humana, ou que provoquem a mortandade de animais ou a destruição significativa da flora.”*

 A norma estabelece que a simples emissão de poluentes sonoros acima dos níveis permitidos já é suficiente para caracterizar o crime. Não é necessário provar que a saúde humana foi efetivamente prejudicada; o potencial para causar danos é o suficiente para configurar a infração.

 ***O contexto do caso***

 O caso julgado pelo STJ teve origem em Minas Gerais, onde o proprietário de um bar foi acusado de poluição sonora por manter níveis de ruído acima do permitido pela legislação local. O Tribunal de Justiça de Minas Gerais (TJ-MG) havia desclassificado a conduta, alegando que seria necessária uma perícia médica para comprovar que os barulhos causaram riscos concretos à saúde humana.

 No entanto, ao analisar o recurso, o STJ reafirmou que o crime é formal e de perigo abstrato. De acordo com o ministro relator Joel Ilan Paciornik, a jurisprudência do tribunal é clara: não é preciso apresentar provas periciais para demonstrar a capacidade do ruído de causar danos. O simples desrespeito às normas de emissão sonora já caracteriza o delito.

 **O crime de perigo abstrato**

 O entendimento do STJ segue a lógica do direito ambiental e penal, que privilegia a prevenção ao dano. No caso da poluição sonora, a lei presume que níveis excessivos de ruído têm o potencial de causar malefícios à saúde humana, dispensando a necessidade de comprovação individualizada.

 Especialistas apontam que a tipificação como crime de perigo abstrato é essencial para garantir a proteção da coletividade. “O ruído excessivo, além de ser uma perturbação, pode gerar efeitos graves, como estresse, insônia e até danos auditivos. Não se trata apenas de incomodar; é uma questão de saúde pública”, explica Edgar Bull, especialista em segurança e saúde no trabalho.

 **A importância da decisão do STJ**

 A decisão do STJ tem implicações importantes para a gestão ambiental e urbana. Ela fortalece o papel das normas regulamentadoras e das fiscalizações, uma vez que o foco está no cumprimento dos limites estabelecidos para emissões sonoras.

 “Se fosse exigida uma perícia em todos os casos, muitos crimes ambientais passariam impunes, dada a dificuldade de comprovar danos concretos a cada indivíduo afetado”, destaca Edgar. “A legislação ambiental não pode esperar que o dano se concretize; ela deve ser preventiva.”

 **Implicações para estabelecimentos comerciais**

 Com a reafirmação de que o crime de poluição sonora é formal, estabelecimentos comerciais, como bares e restaurantes, precisam redobrar a atenção ao controle de ruídos. Isso inclui:

 Monitorar os níveis sonoros regularmente;

 Investir em isolamento acústico;

 Adotar horários rigorosos para eventos e apresentações ao vivo;

 Seguir as regulamentações locais sobre emissão sonora.

 O descumprimento dessas normas pode levar a sanções administrativas, como multas e suspensão de atividades, além de implicações criminais, como no caso analisado pelo STJ.

 A decisão da 5ª Turma do STJ reafirma o caráter preventivo e coletivo da legislação ambiental no Brasil. Ao dispensar a necessidade de perícia para configurar o crime de poluição sonora, o tribunal fortalece o combate a essa forma de poluição, garantindo que a saúde pública seja protegida sem burocracias desnecessárias.

 “A poluição sonora não é um problema menor; ela afeta comunidades inteiras e pode ter impactos profundos na saúde mental e física. O entendimento do STJ é um passo para responsabilizar aqueles que desrespeitam as regras e proteger o direito ao silêncio e ao bem-estar de todos”, conclui Edgar Bull.
